03/12/2011 – José Calvo González“Odia el delito, y compadece al delincuente”. Memoria de Correccionalismo, Antropologia cultural y Literatura popular (“Despise Crime, and Show Compassion for the Criminal”: Recollection of Correctionalism, Cultural Anthropology, and Popular Literature)
The work covers the circumstances of misleading ascription to the writer Concepcion Arenal (1820-1893) of the slogan “Despise crime, and show compassion for the criminal”. Its aim is to: set the place and date on which this author is mentioned and its context and scope; direct the reference according to the theory of correctionalism to a new horizon (of the social reintegration based on the principle of fraternity); use cultural anthropology and popular literature to show excesses and deficits of interpretation of the idea of fraternity among the pious institutions (Compagnia del Santissimo Crocifisso in Italy, XVI-XIX centuries) and mendicant groups (Hermandad de Ciegos de Madrid in Spain, XVI-XIX centuries) related to offenders sentenced to death. At the end, the Author suggests that the motto “Hate the crime, and pity the criminal” can be back in the news as a marker of our convictions in the field of public morality and the idea of Human Dignity.

16/11/2011 – M. Paola MitticaFabbricare il tempo (The Making of Time)
Already appeared on Sociologia del diritto 2003/1, This note draws on an essay by Anne Dufourmantelle about the topic of hospitality, with large use of the Law and the Humanities’ methodology. In Hebrew, the verb to invite is constructed as a compound, using the verbal phrase to create time: understanding this offers another way of penetrating the intimacy of the relationship between host and guest. Being a guest is tantamount to being with others: the possibility to exist because others exist, as a concept feeding on a time as well as a space. The place of the meeting, where the guest is invited, may not necessarily be physical: it may comprise the simple gesture of welcome, as the ability to welcome is the only house where guests will feel really tempted to meet. Dufourmantelle insists on hospitality as solidarity between people who vacillate. This alone does not exhaust the meeting and does not force understanding, risking unexpected consequences waiting in uncertainty. An understanding of the bond of hospitality may be useful for proposing new alliances and new rules. The effort made in this note is the attempt to understand the time dimension of hospitality, a time that is present but also postulates the future, establishes the premises for it, and creates it.

Nussbaum and converses with her about the significance and the future of Law and Literature, observing the important role the humanities play in our lives, private and public. “When I teach a whole course on law and literature,” says Nussbaum, “I always want to focus on the way that literature makes us aware of human complexity, of human emotion, of the importance of each individual struggle to lead a decent life…”

Giuseppe Maria Galanti ” one of the most important exponents of the Neapolitan Enlightenment ” is the author of two Essays on the crime of rape and on the marital laws. These two Essays are particularly important because the legal prose is interwoven with literature and especially with fictional cases. My article aims to investigate the relationship between law, novels, and gender in the Eighteenth century starting from Galanti’s contribution.

‘D(i)ritti tra le righe’ è l’esito di un fruttuoso corso pilota di Diritto e Letteratura che ha avuto luogo nell’a.a. 2009-2010 nell’ambito delle attività della Laurea Magistrale in Sociologia della Multiculturalità, presso la Facoltà di Sociologia dell’Università di Urbino. Il volume raccoglie i contributi di coloro che vi hanno partecipato, con l’intenzione di presentare questa esperienza, auspicando il confronto con altre sperimentazioni didattiche, che si stanno svolgendo presso varie università italiane, e tra gli studenti, i quali hanno accolto con autentico interesse le attività proposte. In tal senso gli ISLL Papers inaugurano, con questa pubblicazione, uno spazio che intende accogliere le rassegne dei lavori di L&L nell’ambito della formazione. L’augurio che i corsi di Diritto e letteratura e di Law and The Humanities possano moltiplicarsi e radicarsi anche nel nostro Paese come sta accadendo al livello internazionale.

Music and law are closely related to one another, because of their common textuality and subsequent necessity for performance. Experts of both disciplines give a performance to a text, solving interpretation problems and choosing the appropriate meaning for the text itself. Judges and musical performers, in trying to resolve interpretation problems, have devised specific strategies, which present interesting common features. This article aims to highlight the analogies between the most common judicial and musical interpretation theories.

20/04/2011 – Domenico SivilliAnatomia del Mostro. Una riflessione sul Male analizzando “M”, il capolavoro di Fritz Lang (Anatomy of a Monster. A Comment about Evil: Analyzing “M,” the Cinematographic Masterpiece by Fritz Lang)
This article takes on the notion of evil with a socio-legal comment proceeding from a short analysis by Fritz Lang’s cinematographic masterpiece “M” (released in Germany in 1931). Considering the lack of any universal definition, the article seeks to find a shared idea of evil in those forms of delirious authority that destroy the vitality of people’s bodies and their sovereignty over their bodies precisely what makes the film’s protagonist abhorrent. This suggests an interesting way to address the subject, by devising a concept that may help us to identify the line dividing lawful power from destructive violence.

The essay deals with the figure of the eminent jurist Russian Anatoliĭ Fedorovich Koni, representative of the current legal liberal-moderate of pre-revolutionary Russia. Recover your interest in the work of the great master of modern Russian literature, Pushkin, who joins the program to modernize the judicial reforms initiated in 1864. Also lists personal relationships with contemporary writers, including those listed in Chekhov, Dostoiesvki, and Tolstoy. On this basis analyzed the overlapping law and literature in two directions, from the legal considerations of literary texts as well as the potential of legal categories in literary creation. Finally, insert the two constructions in the atmosphere of a literary and legal culture from which prefigures the literary modernist and (ephemeral and failed) legal modernist.

Almost every time somebody gives me a present, it ends up making me sad, Holden Caulfield confesses to his little sister Phoebe. This remark is emblematic from a phenomenological point of view, and it offers an occasion to ponder the question of the structural ambiguity of gifting. This essay thus asks why even a welcome gift might make somebody sad, and it singles out three possible answers to this question: first, we have lost the art of gifting; second, every gift establishes or reinforces a bond; and third where things are perhaps most complex’ a gift opens a space of responsibility. Three answers, three names (maybe four): Adorno, Mauss, Derrida (and Patočka). All this bearing in mind Holden’s wish: to care for children playing in fields of rye so that they won’t fall …

23/03/2011 – Luigi AlfieriSul bene e il male ne Il Signore degli Anelli di Tolkien (On Good and Evil in Tolkien’s Lord of the Rings)
Luigi Alfieri offers a reading of Tolkien’s The Lord of the Rings superseding that which sees the novel in a neofascist light, and which has so far been dominant in Italy. Once this stricture is overcome, the novel can shine through in all its richness, making it possible to penetrate the relation between good and evil in its full complexity through a fruitful politico-anthropological analysis. The essay, previously published in Il messaggio dell’imperatore (Turin: Giappichelli, 2006), is now being republished in its original version with the author’s consent.

03/03/2011 – Alberto Andronico“Grande piccolo?” Il problema dell’accettazione (“Big Small?” The Problem of Acceptance)
This essay takes up the question of the reception of foreigners and the linked dialectic between hospitality and hostility, this by offering a ‘reading’ of Lars von Trier’s film Dogville, presented in Cannes in 2003 as the first chapter of a trilogy devoted to the United States. Dogville deals with power, the market, hypocrisy, and guilty conscience. The movie is thus an essay of social critique. But it is also, and perhaps primarily, a masterful and heretical Christological parable. The Dogville community is indeed the perfect antithesis of the Augustinian civitas dei. This gives us a chance to think about the gap between the asymmetrical logic of forgiveness and the symmetrical one of vengeance, between the ethics of hospitality and the legal norms entrusted with regulating the conditions of such ethics.

24/01/2011 – José Calvo GonzálezBionarrativa de la Justicia en el periodismo literario de César Vallejo (Bionarrative of Justice in César Vallejo’s Literary Journalism)
Calvo shows the construction of the methodological category that designates “bionarrative” and defines his profile of conceptual identity in front of others like biography, autobiography, and self-fiction. In the bionarrative writer is so joined to the life experience that relates to how the plot recounts the experience, so that the subjective self and narrative are self, while inherently real and fictional construct. To continuation happens to examine the possibilities of said category applied to texts of literary journalism by César Vallejo related with judicial chronicles, and through which discover his more committed bionarrative on the Justice. The present text is the partial advance of research on Justice and Law in the literary poetry and prose of the Peruvian writer Cesar Vallejo (1892 – 1938).
